These terms govern access to our website and the EnergyIQ monitoring platform. EnergyIQ is a monitoring service, not an energy retailer.
A. Acceptance of terms
By accessing webenergyiq.digital or using the EnergyIQ platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services. These terms are governed by the laws of Western Australia and the Commonwealth of Australia.
EnergyIQ provides monitoring, dashboards, alerts and reporting tools. We do not supply electricity, gas or any other energy retail service.
B. Description of service
EnergyIQ provides software and, where applicable, hardware to monitor electricity and gas consumption at small commercial premises. The service includes dashboards, automated consumption comparisons, baseline-based alerts and export functionality for sustainability reports. EnergyIQ does not sell, supply, broker or resell electricity, gas or any other energy commodity, and is not an energy retailer under any Australian energy retail law.
Information provided through the platform is for monitoring and reporting purposes and should not be treated as professional energy or legal advice.
C. Nature of information provided
Dashboards, comparisons, alerts and reports generated by EnergyIQ are intended to help premises operators understand their own consumption patterns. This information does not constitute financial, legal, engineering or energy procurement advice. Decisions regarding tariffs, contracts, building works or compliance obligations should be made in consultation with appropriately qualified professionals.
Accounts must be kept secure and used only for lawful, accurate business purposes.
D. Account responsibilities
Customers are responsible for maintaining the confidentiality of account credentials and for all activity occurring under their account. Information provided during account setup, including premises details and metering configuration, must be accurate to the best of the customer's knowledge.
The service is provided on an "as is" and "as available" basis without guarantees of uninterrupted operation.
E. Availability and limitations
While we aim for the platform to operate reliably, we do not warrant that access will be uninterrupted, error-free or available at all times. Scheduled maintenance, third-party connectivity issues, or metering hardware faults may affect availability. We are not liable for losses arising from temporary unavailability of the service.
All website and platform content remains the intellectual property of EnergyIQ unless otherwise stated.
F. Intellectual property
All text, graphics, software and design elements on this website and within the platform remain the property of EnergyIQ or its licensors. Customers may not reproduce, redistribute or reverse-engineer any part of the platform without prior written consent.
Liability is limited to the extent permitted under Australian Consumer Law.
G. Limitation of liability
To the extent permitted by law, EnergyIQ excludes liability for indirect or consequential loss arising from use of the website or platform. Nothing in these terms excludes rights that cannot be excluded under the Australian Consumer Law, including consumer guarantees that apply to the supply of goods and services.
Either party may terminate access to the platform in accordance with the applicable service agreement.
H. Termination
We may suspend or terminate access to the platform if these terms are breached, or if continued provision of the service becomes impractical. Customers may cancel their subscription in accordance with the terms of their individual service agreement.
These terms may be revised from time to time, with the current version always available on this page.
I. Changes to these terms
We may amend these Terms of Service periodically. Updated versions will be posted on this page with a revised effective date. Continued use of the website or platform after changes take effect indicates acceptance of the revised terms.
